An individual identified only as "L***y." The Complainant does not know whether "L***y" is the individual's legal first name, legal surname, or an alias. The designation "L***y" is used throughout this Incident Report solely as an identifying reference based upon the Complainant's understanding and is not intended to represent the individual's verified legal identity.

Incident Type:
Reported verbal harassment; reported identity-related statements; reported denial of the Complainant's identity; reported claim of ownership over the Complainant's intellectual properties; concern regarding possible identity misuse; concern regarding possible harassments directed towards the Complainant; request for preservation of evidence and investigation.

1. Purpose of This Incident Report

This Incident Report documents statements that I personally report hearing on the morning of July 14, 2026, while inside my residence located at **** **** ****** *****, *** **5, *****, ***** ******.

The purpose of this report is to create a contemporaneous record of the incident, preserve my recollection of the reported statements, document the effect those statements had upon me, preserve evidence for any future investigation, and formally request that appropriate governmental authorities determine whether additional investigation is warranted.

This report distinguishes between:

  • facts personally known to me;
  • statements I personally report hearing;
  • my observations of the reported misconduct;
  • my resulting concerns; and
  • requests for investigation by the appropriate authorities.

Nothing contained in this report should be interpreted as a medical diagnosis of any person or as a legal conclusion that any criminal offense has occurred. Rather, this report documents my observations and requests that qualified investigators determine the relevant facts.

2. Summary of Incident

On Tuesday, July 14, 2026, at approximately 6:45 A.M., I was awakened by a loud male voice that I believe belonged to an individual known to me only as L***y, whom I believe resides at or near ********* **5 within the same residential complex.

The voice appeared to originate from either an exterior patio area or an open bedroom window. Because I had been asleep immediately before hearing the statements, I cannot state with certainty the precise location from which the voice originated.

According to my recollection, I heard statements substantially similar to the following:

"I AM SPREADING RUMORS ABOUT YOU BECAUSE YOU REFUSE TO SAY YOU ARE A MALE FROM BIRTH AND I HAVE STARTED THIS HATE CRIME AGAINST YOU AND YOUR FEDERAL CASE WAS BLOTCHED BY ME BECAUSE I AM YOU AND I HAD CLAIMED YOUR IDENTITY WAS MINE AND I DID NOT FILE THAT FEDERAL CASE AND YOU DO NOT OWN ENCODED RADIANCE STUDIO WEBSITE, I OWN IT."

The above quotation reflects my best recollection of what I personally heard on the morning of July 14, 2026.

The reported statements immediately caused me concern because they appeared to reference:

  • my identity;
  • my biological female sex assigned at birth;
  • my legal matters;
  • my federal court proceedings;
  • my personal identity;
  • my intellectual property; and
  • ownership of the Encoded Radiance Studio website and related creative works.

Because of the nature of the reported statements, I believe it is important to preserve an accurate record while the events remain fresh in my memory.

3. Chronology of Events

A. Morning of July 14, 2026

At approximately 6:45 A.M., I was asleep inside my apartment when I was awakened by a loud male voice.

The volume of the voice was sufficient to awaken me from sleep.

Based upon prior familiarity with the individual's voice, I believe the voice belonged to an individual known to me only as L***y.

I cannot independently verify the precise location from which the statements originated.

B. Statements Personally Reported by the Complainant

Immediately after awakening, I heard the individual make statements that I understood to concern my personal identity.

Among the reported statements were assertions that, in my understanding, included:

  • denying my biological female identity;
  • claiming to be on my identity;
  • claiming ownership of my identity;
  • claiming responsibility for matters relating to my federal legal proceedings; and
  • claiming ownership of the Encoded Radiance Studio website, I have just created over the weekend.

I recorded these statements from memory as soon as practicable after the incident.

C. Immediate Effect

Immediately following the reported statements, I became concerned regarding:

  • my personal safety;
  • continued verbal harassments;
  • preservation of evidence;
  • protection of my personal identity;
  • protection of my intellectual property;
  • preservation of my legal rights; and
  • documentation of the incident for possible future investigative review.

Accordingly, I began preparing this Incident Report while the details remained fresh in my recollection.

4. Formal Denial of Authority, Consent, Power of Attorney, Guardianship, Marriage Record, and Similar Instruments

I formally state that I have never granted the individual identified in this report as L***y, or any other unknown person acting on his behalf, authority to use my name, identity, personal-identifying information, intellectual property, digital accounts, or legal status for any purpose.

Specifically, I have never granted L***y, or any person claiming to act through or with L***y, authority to:

  • act as my legal representative;
  • represent that he is me;
  • represent that I am him;
  • claim ownership of my identity;
  • claim ownership of my intellectual property;
  • claim ownership of my copyrights;
  • claim ownership of Encoded Radiance Studio;
  • claim ownership of my domains, websites, software projects, writings, or creative works;
  • sign documents on my behalf;
  • submit documents on my behalf;
  • file court documents on my behalf;
  • record documents on my behalf;
  • exercise authority under any Power of Attorney;
  • execute affidavits in my name;
  • execute waivers in my name;
  • create or rely upon any guardianship, conservatorship, agency relationship, fiduciary relationship, or representative authority involving me.

I further state that I have never authorized L***y, or any unknown individual acting with or through him, to use my:

  • North Dakota Real ID Driver License Card;
  • Social Security Number;
  • Birth Certificate;
  • Passport, if applicable;
  • digital devices;
  • online accounts;
  • authentication credentials;
  • intellectual property;
  • trademarks;
  • copyrights;
  • software source code;
  • business records; or
  • personal identifying information.

I further state that I have never entered into, authorized, consented to, signed, or knowingly participated in any:

  • marriage license;
  • marriage certificate;
  • common-law marriage;
  • domestic partnership;
  • civil union;
  • Power of Attorney;
  • guardianship;
  • conservatorship;
  • affidavit;
  • waiver of rights;
  • authorization form;
  • agency appointment;
  • fiduciary appointment; or
  • similar legal instrument involving L***y or any unknown individual claiming authority over my identity.

If any such document purports to exist, I expressly state that I did not authorize it, did not knowingly execute it, dispute its authenticity, and deny that it reflects my consent.

5. Statement Regarding the Unknown Individual Identified as "L***y"

Throughout this Incident Report, I identify the individual involved in the reported incident only by the name "L***y."

At the time this Incident Report is being prepared, I do not know whether "L***y" is the individual's legal first name, legal surname, nickname, alias, or another identifying designation.

Accordingly, the designation "L***y" is used solely as an identifying reference for the person whose voice I believe I recognized on the morning of July 14, 2026, and is not intended to represent or verify the individual's legal identity.

I do not personally know this individual or any other person or tenants.

To the best of my knowledge:

  • I have never introduced myself to him.
  • I have never voluntarily communicated with him.
  • I have never established any friendship or personal relationship with him.
  • I have never maintained any business relationship with him.
  • I have never entered into any contractual relationship with him.
  • I have never entered into any romantic relationship with him.
  • I have never entered into any marriage with him.
  • I have never entered into any common-law marriage with him.
  • I have never shared financial accounts with him.
  • I have never granted him access to my personal records.
  • I have never authorized him to represent me in any legal, governmental, financial, administrative, or personal capacity.

If investigators determine that the individual known as "L***y" is using another legal name or another identifying alias, I respectfully request that this Incident Report be read as referring to that same individual once his identity has been lawfully established.

I further state that I have never authorized any unknown person to represent themselves as being me, to substitute their identity for mine, or to assert ownership over my identity, personal records, creative works, intellectual property, software projects, websites, business interests, or legal matters.

To the extent any person has represented otherwise, I expressly dispute those representations and request that the appropriate authorities determine their origin and factual basis.

6. Behavioral Observations and Request for Professional Psychological Evaluation

Based upon the statements I personally reported hearing on July 14, 2026, the individual identified by me as "L***y" appeared to assert that he was on my identity, denied my identity as a biological female from birth, and claimed ownership or control over matters that I understand to belong to me, including my personal identity, my legal matters, and my Encoded Radiance Studio intellectual property.

According to my recollection, the reported statements suggested that the individual believed he could substitute his identity for mine or otherwise claim rights that I have never granted.

If those statements were accurately made and accurately attributed to the individual, they may raise concerns regarding his perception of my identity and his understanding of personal identity boundaries.

I make no medical, psychiatric, or psychological diagnosis of the individual.

I am not qualified to determine whether any mental health condition exists.

Nevertheless, because the reported statements involve apparent claims concerning my identity as a biological female from birth, assertions of ownership over my identity and intellectual property, and statements that could reasonably be interpreted as confusing or conflating his identity with that of another individual, I respectfully request that law enforcement authorities, prosecutors, or a court, if deemed appropriate under applicable law, consider whether a comprehensive psychological or psychiatric evaluation of the individual would assist investigators in determining:

  • the individual's competency;
  • his perception of reality;
  • his judgment;
  • his ability to distinguish his own identity from that of another person;
  • whether he understands personal identity boundaries;
  • whether he presents a continuing risk of identity-related harassments toward another individual; and
  • whether additional protective measures may be appropriate.

This request is made solely for investigative purposes and is not intended to constitute a medical opinion or diagnosis.

Any determination concerning the existence of a psychiatric, psychological, neurological, cognitive, or other medical condition should be made exclusively by licensed psychiatrists, licensed psychologists, or other qualified medical professionals after an appropriate clinical evaluation.

7. Harm, Safety Concerns, and Effect Upon the Complainant

As a direct result of the reported incident, I experienced significant concern regarding my personal safety, privacy, identity, and intellectual property.

The reported statements caused me to become concerned that additional acts of verbal harassment, intimidation, or identity-related misconduct could occur in the future.

The incident also interrupted my sleep and my quiet enjoyment of my residence.

Because the reported statements specifically referenced my personal identity, legal matters, and ownership of my creative works, I became concerned that similar statements, if repeated publicly, could create confusion regarding my identity or ownership of my intellectual properties.

Accordingly, I determined that it was necessary to immediately preserve my recollection of the incident through this written report.

This documentation is intended to assist any future investigation by preserving the chronology of events while my memory remains fresh.

8. Evidence Preservation and Requested Investigation

I respectfully request that all appropriate investigative agencies preserve any available evidence relating to the incident described in this report.

Potential evidence may include, but is not necessarily limited to:

  • surveillance recordings maintained by the apartment complex;
  • exterior security camera recordings;
  • neighboring residential security cameras;
  • lawfully obtained audio recordings, if any exist;
  • witness statements from individuals who may have heard the reported shouting;
  • building access records, if relevant;
  • maintenance records identifying apartment occupancy;
  • photographs;
  • electronic communications, if later discovered;
  • digital forensic evidence, if lawfully obtained;
  • any additional evidence developed during an official investigation.

I further request that investigators determine, as appropriate:

  • the legal identity of the individual identified in this report as "L***y";
  • whether additional witnesses observed or heard the reported incident;
  • whether any statements were directed specifically toward me;
  • whether similar conduct has been reported by other individuals;
  • whether additional evidence exists that corroborates or refutes the reported statements;
  • whether any violations of federal, state, or local law occurred; and
  • whether protective measures or additional investigative steps are warranted.

This Incident Report is submitted in good faith for documentation purposes and to assist any lawful investigation conducted by authorized governmental agencies.

9. Federal Statutes and Legal Concerns Potentially Implicated

This section does not state a final legal conclusion or judicial finding. Rather, it identifies federal statutes that investigators, prosecutors, or legal counsel may determine are relevant if supported by independently developed evidence.

A. Civil Rights and Conspiracy Against Rights

18 U.S.C. § 241 — Conspiracy Against Rights

This statute prohibits two or more persons from conspiring to injure, oppress, threaten, or intimidate any person in the free exercise or enjoyment of rights secured by the Constitution or laws of the United States.

If investigators determine that multiple individuals knowingly acted together to deprive me of federally protected rights because of my identity or other protected characteristics, this statute may warrant review.

18 U.S.C. § 242 — Deprivation of Rights Under Color of Law

If investigators determine that any person acting under color of law knowingly deprived me of rights protected by the Constitution or federal law, this statute may warrant consideration.

At the time of preparing this report, I make no allegation that this statute applies to any specific person.

B. Identity Documents and Identity Fraud

18 U.S.C. § 1028 — Fraud and Related Activity in Connection with Identification Documents

If investigators determine that any person knowingly used, transferred, possessed, or attempted to use identification documents or personal identifying information belonging to another individual without lawful authority, this statute may warrant review.

18 U.S.C. § 1028A — Aggravated Identity Theft

If investigators determine that another felony offense involved the unlawful use of another person's means of identification, this statute may also warrant consideration.

C. Computer Systems and Electronic Devices

18 U.S.C. § 1030 — Computer Fraud and Abuse Act

If forensic examination establishes unauthorized access to protected computers, digital accounts, cloud services, mobile devices, or electronic communications, investigators may determine whether this statute is applicable.

This report does not independently establish that unauthorized computer access occurred.

D. Wire Fraud

18 U.S.C. § 1343 — Wire Fraud

Should investigators determine that interstate electronic communications were knowingly used as part of a fraudulent scheme involving identity, financial benefit, intellectual property, or other protected interests, this statute may warrant consideration.

E. Witness Intimidation and Obstruction

18 U.S.C. § 1512 — Witness Tampering

If investigators determine that statements or conduct were intended to intimidate, influence, or interfere with a witness, victim, or participant in a federal proceeding, this statute may be relevant.

18 U.S.C. § 1519 — Destruction, Alteration, or Falsification of Records

If investigators discover that documents, electronic records, digital evidence, or other materials were intentionally altered, concealed, or destroyed in connection with an investigation, this statute may warrant review.

F. Interstate Stalking or Harassment

18 U.S.C. § 2261A — Interstate Stalking or Cyberstalking

If investigators determine that conduct satisfying the statutory elements occurred through electronic communications or other means, this statute may warrant review.

G. Interstate Threatening Communications

18 U.S.C. § 875

If investigators determine that interstate communications contained threats prohibited by federal law, this statute may also warrant consideration.

H. Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act

18 U.S.C. § 249

Because the statements I reported hearing expressly referenced my identity as a biological female from birth and included language that I understood to be directed toward that aspect of my identity, I respectfully request that investigators determine whether any facts support consideration of this statute.

This report does not independently establish that the statutory requirements have been met.

I. Intellectual Property Concerns

The reported statements also included an apparent claim of ownership over my Encoded Radiance Studio website and related intellectual property.

I respectfully request that investigators determine whether any person has knowingly misrepresented ownership of my original creative works, copyrighted materials, software projects, domain names, branding, business goodwill, or related intellectual property.

This report does not independently establish that any intellectual property offense has occurred but documents my concern arising from the statements I reported hearing.

10. Requested Investigative Actions

I respectfully request that the appropriate investigative authorities consider the following actions, as authorized by law:

  • Identify the legal identity of the individual referred to in this report as "L***y."
  • Determine whether witnesses observed or heard the reported incident.
  • Preserve available surveillance recordings before they are overwritten.
  • Preserve any available electronic evidence relevant to this matter.
  • Determine whether similar incidents have been reported by other individuals.
  • Determine whether any criminal statutes or civil causes of action are implicated.
  • Determine whether additional protective measures are appropriate.
  • Determine whether forensic examination of digital evidence is warranted if independent evidence establishes a basis for such examination.
  • Determine whether referral to other governmental agencies is appropriate.

I further request that investigators preserve all evidence developed during any official investigation in accordance with applicable law and agency procedures.

11. Reservation of Rights

Nothing contained within this Incident Report shall be construed as:

  • waiving any constitutional rights;
  • waiving any civil remedies;
  • waiving any statutory protections;
  • waiving any contractual rights;
  • waiving any intellectual property rights;
  • waiving any copyrights;
  • waiving any trademark rights;
  • waiving any privacy rights;
  • waiving any ownership interests;
  • admitting liability;
  • consenting to representation by any other person; or
  • recognizing the authority of any unauthorized individual to act on my behalf.

I expressly reserve all rights and remedies available to me under:

  • the Constitution of the United States;
  • applicable federal statutes;
  • the laws of the State of North Dakota; and
  • any other applicable civil or criminal law.

Nothing in this report shall be interpreted as granting authority to any person to represent me, substitute their identity for mine, exercise authority over my affairs, or assert ownership of my identity or intellectual property.

12. Closing Statement

I prepared this Incident Report promptly following the events described herein while the details remained fresh in my recollection.

This report accurately reflects my personal observations, my recollection of the statements I reported hearing, my resulting concerns, and my request that appropriate governmental authorities conduct whatever investigation they determine appropriate under applicable law.

I respectfully request that this Incident Report be maintained as part of the official investigative record together with any future supplemental reports, witness statements, documentary evidence, digital forensic evidence, surveillance recordings, photographs, audio recordings, or other materials that may later become available.
